Obtain an EPC

Energy Performance Certificates are a legal requirement for a building to be sold, let or constructed in England and Wales. The certificate rates the energy efficiency of a property and its carbon emissions. As of 6th April 2012, developers and sellers must display the EPC details on all property particulars.

Instructing a solicitor (conveyancer)

Conveyancing is the term used to describe the legal process you must go through when buying or selling a home. You can choose whether you want the procedure done by a solicitor or a licensed conveyancer. When talking to either, make sure you inquire about fees and any other legal costs involved and when these are payable.  At The Real Property Experts, we can recommend a solicitor if you do not have one.

Receiving an offer

You will receive all offers verbally and in writing. These will go through validity checks, and we will ask for proof of funds before going any further.

The Real Property Experts team will conduct checks under the Proceeds of Crime Act 2002 and Money Laundering Regulations 2003 and ensure that any mortgage offer is verified. 

If you receive several offers for your property, our experts will guide you through your option and advise you on the best course of action.

Offer agreed

Before committing to any legally binding agreement, The Real Property Experts will liaise with the buyers' representatives to verify their financial commitment. 

Upon agreement, the expert negotiators will contact your solicitor and the buyer's solicitor, prepare the memorandum of sale, and prepare the confirmation documents.

Your representative will prepare a draft contract to detail the terms of the sale and forward it to the buyers' solicitor with all relevant documents. The buyer's solicitor will then start the preliminary checks. They will check the Title Deeds and Lease (if applicable), and carry out local searches.

Note that an offer is not legally binding in England until contracts have been exchanged, meaning your buyer could change their minds without financial loss.

Exchange contracts

Once both parties sign the contracts, the contract will become legally binding, and the solicitor will request the buyer's deposit. After this stage, if the deal falls through, the deposit is forfeited. A completion date is set and agreed upon by both you and the purchaser. Unless agreed otherwise, the completion date can be anything up to 28 days from the exchange date.

Organise your move

At this stage, you need to organise your moving out. Remember to arrange all removals and inform government bodies, friends and family about your change of address. You will have to ensure you have booked any disconnections/re-connections of services for your new home. Remember that the property will legally transfer to the new buyers on the date of completion, so allow plenty of time to move out.
